By using the washingtonareafuelfund.org site (“Site”) you signify your agreement to all terms, conditions and notices contained or referenced herein the Terms and Conditions of Use (the “Terms of Use”). If you do not agree to these Terms of Use, please do not use this Site. Although you may “bookmark” a particular portion of this Site and thereby bypass this Agreement, your use of this Site binds you to the terms. We reserve the right at our discretion, to update or revise these Terms of Use. Please check the Terms of Use periodically for changes. Your continued use of this Site following the posting of any changes to the Terms of Use constitutes your acceptance of these changes.

Agreement to Rules of User Conduct

You agree to abide by all applicable laws and rules of conduct applicable to this Site, including the Washington Gas Rules of User Conduct, and you agree not to use this Site for any unlawful purpose.

Proprietary Rights

You acknowledge and agree that all content and materials available on this Site are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by The Washington Area Fuel Fund (“WAFF”), you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from such materials or content. Notwithstanding the above, you may print or download one copy of the materials or content on this Site on any single computer for your personal, non commercial use, provided you keep intact all copyright and other proprietary notices. Systematic retrieval of data or other content from this Site to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from WAFF is prohibited. In addition, use of the content or materials for any purpose not expressly permitted in these Terms of Use is prohibited.
As noted above, reproduction, copying, or redistribution for commercial purposes of any materials or design elements on this Site is strictly prohibited without the express written permission of WAFF. Permission is granted only when certain limited criteria are met. For information on requesting such permission, please send an e-mail to: [email protected] with the words “WAFF Permission Request” in the subject line, and include the following information in the body of the message:

  • The Washington Gas or WAFF content you wish to use.
  • Where and how such content will be used (for example, in a manual, a presentation).
  • Where and how copies will be produced and distributed.
  • When you intend to publish the content.
  • Other non-Washington Gas materials that will be associated with the Washington Gas or WAFF content.
  • Your name, title, company, address, email address and telephone number.

In addition, please provide an example or mockup of the intended use, by sending a file attached to your e-mail (in a format readable with a PC). We will need all of the above in order to evaluate your request. WAFF reserves the right to refuse permission to copy, distribute, broadcast or publish any of its copyrighted material.

User Comments, Feedback, Postcards and other Submissions

All comments, feedback, postcards, suggestions, ideas and other submissions disclosed, submitted or offered to WAFF on or by this Site or otherwise disclosed, submitted or offered in connection with your use of this Site (collectively “Comments”), shall be and remain the property of WAFF . Such disclosure, submission or offer of any Comments shall constitute an assignment to WAFF of all worldwide rights, titles and interests in all copyright and other intellectual properties in the Comments. Thus, WAFF will own exclusively all such rights, titles, and interests shall not be limited in any way in its use, commercial or otherwise, of any Comments. WAFF is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay to user any compensation for any Comments; or (3) to respond to any user Comments.

You agree that no Comments submitted by you to this Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). You further agree that no Comments submitted by you to the Site will be or will contain libelous or otherwise unlawful or abusive material.

These other third party sites are not under the control of WAFF , and you acknowledge that WAFF is not responsible for the accuracy, copyright compliance, legality, decency or any other aspect of the content of such third party sites. Warranties and Limitation of Liability

While WAFF uses reasonable efforts to include accurate and up-to-date information on this Site, it makes no representation as to the accuracy, timeliness or completeness of that information, and you should not rely upon it. In using this Web site, you agree that its information and services are provided “as is,” “as available,” without warranty, express or implied, and that you use this Site at your risk.

Applicable Laws

This Site can be accessed from all 50 states as well as from other countries around the world. However, by accessing this Site, you expressly agree that the exclusive jurisdiction for any claim or action arising out of relating to these Terms of Use or your use of this Site shall be filed only in the state or federal courts located in the Commonwealth of Virginia, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. These Terms of Use shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, excluding its conflict of rules laws.

WAFF makes no representation that materials on this Site are appropriate or available for use in other locations, and accessing them from territories where their contents may be illegal is prohibited. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with the local laws.

Indemnification

Upon request by WAFF, you agree to defend, indemnify and hold harmless WAFF and its subsidiaries and other affiliated companies and their employees, contractors, officers and directors from all liabilities, claims and expenses including attorney fees, that arise from your use or misuse of this Site. WAFF reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with WAFF in asserting any available defenses.

Site Security

Violations of the Site security may result in civil or criminal penalties. WAFF will investigate occurrences that may involve such violations, and cooperate with law enforcement authorities in prosecuting users who are involved in such violations.

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and WAFF with respect to this Site and supersedes all prior or contemporaneous communications and proposals, (whether written or electronic) between you and WAFF with respect to this Site. If any part of these Terms of Use is held invalid or unenforceable that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intention of the parties, and the remaining portions shall remain in full force and effect.

Termination

WAFF reserves the right, at its sole discretion, to terminate your access to all or part if this Site with or without notice.
